1. Acceptance of Terms

Welcome to Community Wellness (“we,” “our,” “us”). Community Wellness includes affiliates Community Wellness Technology Inc., its subsidiaries, and Community Wellness Medical Associates. By accessing and using our telehealth services (the “Services”) through our websites and platform applications such as https://communitywellness.com and CWConnect TM (“Sites”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Services.

The information provided on the Sites are not a substitute for the advice of a personal physician or other qualified health care professional and does not constitute a diagnosis or professional treatment recommendation.

If you think you or someone you are taking care of has a medical or psychiatric emergency, call 911 or go to the nearest hospital.

Before receiving any Services, you must review and sign our Patient Agreement for Telehealth Services and our Informed Consent for Telehealth Services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements.

3. Consent to Receive Electronic Communications

You consent to receive important communications and documents (such as notices, videos and telephony) regarding or related to the Services through electronic means such as the email address and/or mobile number specified by you for this purpose.

4. Services Provided

Our Services include telehealth consultations, medical advice, prescriptions, and other related healthcare services. We strive to provide accurate and up-to-date information, but we do not guarantee that the information provided is always current or complete.

5. User Responsibilities

Registration: You may be required to register and create an account to access certain features of our Services. You are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activities that occur under your account.

Accurate Information: You agree to provide accurate, current, and complete information about yourself as prompted by our registration forms and to update such information to keep it accurate, current, and complete.

Compliance: You agree to comply with all applicable laws and regulations while using our Services.

6. Privacy Policy

Your use of our Services is also governed by our Privacy Policy, which can be found https://communitywellness.com/privacy-policy. By using our Services, you consent to the collection and use of your information as outlined in our Privacy Policy.

7. Telehealth Consultations

Nature of Telehealth Services: Our telehealth services involve the delivery of healthcare services using electronic communications, information technology, or other means between a healthcare provider and a patient who are not in the same physical location.

Limitations: Telehealth services have certain limitations, including the potential for incomplete or inaccurate transmission of information, unauthorized access, and technical difficulties. By using our telehealth services, you acknowledge and accept these limitations.

8. Prescription Services

Prescription Delivery: If prescribed by our healthcare providers for prescription delivery, medications may be delivered to your address as provided during registration. You agree to receive prescriptions through our partner pharmacies.

Refunds: Prescriptions are non-refundable.
 

Medication Management: You are responsible for managing your medications and adhering to the prescribed treatment plan. Any adverse reactions or questions about medications should be promptly reported to our healthcare providers.

9. Intellectual Property

All content, trademarks, service marks, logos, and other intellectual property displayed on our Services are the property of Community Wellness or its licensors. You are not granted any rights to use such intellectual property without our prior written consent.

10. Disclaimer and Limitation of Liability

DISCLAIMER OF WARRANTIES:  THE SITES AND ANY CONTENT, INFORMATION, SERVICES OR PRODUCTS OBTAINED THROUGH THE SITES ARE PROVIDED “AS IS,” WITH ALL FAULTS, WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON­ INFRINGEMENT. YOUR USE OF THE SITES AND SERVICES ARE VOLUNTARY AND AT YOUR OWN RISK.

LIMITATION OF LIABILITY:  TO THE FULLEST EXTENT PERMITTED BY LAW, COMMUNITY WELLNESS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OUR SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES; OR (D) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY.

11. Sole Remedy

YOUR SOLE REMEDY FOR DISSATISFACTION WITH OUR SITES AND SERVICES IS TO STOP USING THE SITES AND SERVICES AND CANCEL YOUR ACCOUNT AND/OR SUBSCRIPTION.

12. Indemnification

You agree to indemnify, defend, and hold harmless Community Wellness and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of our Services or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

14. Changes to Terms

We may modify these Terms at any time. Any changes will be effective immediately upon posting of the revised Terms. Your continued use of our Services after the posting of the revised Terms constitutes your acceptance of the changes.
